ARTICLE 5.01

GENERAL PROVISIONS (RESERVED)

ARTICLE 5.02

FIRE DEPARTMENT

§ 5.02.001 Fire commissioner.

The purpose of this section is to define the position of fire commissioner for the city. This requires

repealing Ordinance 26 dated May 1, 1985 and re-establishing what the city council expects of the

person appointed to fill this position. The fire commissioner is responsible for providing the city

council a quarterly recap of fire department activities, other items of interest and/or information as

required, and a quarterly financial status showing any significant variations from the current year

budget. Each August, a summarized budget showing expected income and expense projections for the

coming fiscal year will be provided to the city council. Additionally, the fire commissioner may be

asked to respond to questions asked of the city concerning the fire department.

§ 5.02.002 Fees for emergency and rescue services.

(a) Findings.

(1) The city council adopted this section providing for the collection of fees and costs for

emergency and rescue services by the Lowry Crossing Volunteer Fire Department, Inc. (the

department);

(2) The department desires to adjust the amounts for emergency and rescue services and set out

in the attached exhibit A to Ordinance 283; and

(3) The city has determined that the department should have the ability to recoup some of the

costs incurred with providing these emergency and rescue services at current recovery rates,

including billing for false alarms.

(b) Fees established.The city hereby authorizes the department to bill persons or entities, including

insurance companies that provide insurance coverage to said persons and entities, for reasonable

fees and costs as enumerated and set out in exhibit A to Ordinance 283.

(c) Incident report information.Fees may be collected for services, per exhibit A to Ordinance 283,

provided by the department both inside and outside the city limits in accordance with this

section. Applicable incident report information shall be utilized and forwarded to the

department’s authorized agent for the collection of fees.

(d) Collection.The department or its authorized agent shall submit an invoice to the person, entity,

or relevant insurance company covering the particular loss, for the emergency services rendered.

If it can be reliably determined that there is no insurance coverage for a particular emergency

call, which causes the department to use or incur loss, damage, and wear and tear to apparatus,

tools, equipment, and materials, the department may collect such fees from the person or entity

that received said emergency services or the person or entity responsible for the debts and

obligations of the person or entity that received or benefited from such emergency services.

ARTICLE 5.03

FIRE CODE

§ 5.03.001 Adoption.

The 2009 edition of the International Fire Code, as published by the International Code Council (the

“fire code”), as amended hereby, is hereby adopted and designated as the fire code for the city, and is

made a part hereof for all purposes. A copy of said fire code and this ordinance shall be kept on file in

the office of the city secretary. From the date on which this section takes effect, the provisions of the

International Fire Code, 2009 edition, as amended hereby, shall be controlling within the limits of the

city, and shall (except as provided for herein) supersede and replace any previously adopted fire codes.

§ 5.03.002 Amendments.1

§ 5.03.003 Violations; penalty.

It shall be unlawful for any person, firm, corporation, or other business entity to violate any provision

of this article, and any person, firm, corporation, or other business entity violating or failing to comply

with any provision hereof shall be fined, upon conviction, in an amount of not more than two thousand

dollars ($2,000.00), and a separate offense shall be deemed committed each day during or on which a

violation or failure occurs or continues.
